WHAT YOU NEED TO KNOW
- Federal investigators identified 405 suspected noncitizens who allegedly cast more than 1,500 ballots in Washington elections.
- Neil Floyd warned the findings may be only the beginning and said the statewide total could reach thousands.
- Washington declined to provide its complete voter database, forcing investigators to compare records one person at a time.
- The Justice Department also sued California over mailed ballots from more than 20,000 voters identified as likely noncitizens.
Federal prosecutors said Monday that investigators have identified 405 people they believe are not U.S. citizens who voted in Washington state elections. According to prosecutors, those individuals cast more than 1,500 ballots across multiple elections, as reported by Breitbart.
Neil Floyd, the acting U.S. attorney for the Western District of Washington, said federal officials provided the names to state election authorities. They also asked officials to set aside any ballots from those voters until their eligibility can be reviewed.
Floyd said investigators had reached their findings with high confidence, but he warned that the identified cases may represent only a fraction of the noncitizens who have voted in Washington elections.
“Through our investigation, we have confirmed with high confidence that non-citizens are voting in the state of Washington in federal and state elections.”

The acting U.S. attorney said investigators had found more than 400 noncitizens who voted, with many allegedly voting multiple times. That activity produced more than 1,500 ballots that Floyd described as illegally cast.
“Thus far, we have identified over 400 non-citizens who have voted in Washington, and many of them have voted multiple times. That means we have identified over 1,500 ballots illegally cast.”
Floyd went further, describing the current findings as an early glimpse of a potentially larger problem. He said the limited sample collected by investigators gave him confidence that thousands of noncitizens may have voted in Washington.
“This is not the full number of non-citizens who have been voting in Washington. This is only the tip of the iceberg.”
“With a small sample that we have collected so far, I’m confident that we are looking at thousands of non-citizens who have been voting in Washington.”
Floyd did not provide a statewide total supporting his estimate that thousands of noncitizens had voted. A report on the investigation said the more than 1,500 ballots cited by Floyd were allegedly cast over several decades.
The request to Washington election officials comes ahead of the November 3 midterm elections. Federal officials want ballots connected to the identified voters set aside until officials can verify whether those people are eligible to participate.
Floyd said investigators from the Department of Homeland Security compared publicly available Washington voter lists with federal records. They used that comparison to identify registered voters believed to be noncitizens, then checked whether those individuals had cast ballots.
Investigators had to perform several checks to determine whether records from different sources referred to the same person, Floyd said. That process made the investigation time-consuming and forced officials to work through the records individually.
Washington has declined to give the federal government its complete voter registration database, including personal identifying information. Floyd said the refusal has prevented investigators from conducting the comparison more efficiently.
“Washington has refused to share the complete list of registered voters with identifying information. We are having to do this essentially one person at a time.”
“If we had access to the full database maintained by Washington, this could be done much more efficiently. We could simply compare Washington’s information to ours, and it would yield immediate results.”
Floyd said his office intends to pursue criminal cases against people who vote illegally. He also said prosecutors would target anyone who knowingly assists another person in casting an illegal vote.

The Washington allegations follow a separate dispute involving voter citizenship records in California. Los Angeles County officials told a court they could not independently verify voters’ citizenship beyond the information voters supplied on their registration forms, Breitbart News reported last week.
The Justice Department sued California to prevent the state from counting mailed ballots from more than 20,000 registered voters identified by federal officials as likely noncitizens.
The federal government sought to halt those ballots until citizenship could be verified, while California officials challenged the evidence supporting the list.
